ConcludedThe Supreme Court of India upheld service punishment imposed on police personnel.
The judgment of the Supreme Court of India records the following account. [name withheld], appointed Constable in the Jharkhand Police in May 2005 and serving as Reserve Guard at Dhurki Police Station, took two days compensatory leave from 20 December 2007 and never rejoined. The Court recorded that during that absence he secured appointment as Constable in the Bihar Police under the name [name withheld] on forged certificates, then abandoned the Patna posting in January 2008. A forensic comparison of fingerprints, biometrics and photographs confirmed both names were one person, and the Superintendent of Police, Garhwa dismissed him in August 2010. The writ court sustained the dismissal but the Division Bench set it aside; the Supreme Court restored the dismissal as proportionate, quashed the Bihar appointment under Article 142, and directed the DGPs to examine criminal proceedings. Matters not addressed in the cited judgment text are not recorded here.
