CW-2026-0043Kannur, KeralaJudgment 21 January 2026

Karikkottakkari Man v. Dy. S.P., VACB Unit-1 Kannur & State of Kerala

The Kerala High Court (single bench) confirmed the conviction of Sub-Inspector of Karikkottakkari Police Station by the Enquiry Commissioner & Special Judge, Kozhikode (CC No. 19 of 2005) for demanding and accepting Rs 3,000 in marked notes from an autorickshaw driver to avoid foisting a case on him. The Court held demand and acceptance proved through the complainant corroborated by witnesses and the trap recovery, rejecting the defence of a false case. Accepting the plea for leniency, it reduced the sentence to the statutory minimum of six months' RI with Rs 10,000 fine under s.7 and one year's RI with Rs 10,000 fine under s.13(1)(d) r/w s.13(2), concurrent. It cancelled the appellant's bail and directed him to surrender forthwith. Matters not addressed in the cited judgment text are not recorded here.
