ConcludedThe Kerala High Court recorded adverse findings against police personnel and ordered Rs 500,000.
The judgment of the Kerala High Court records the following account. On 2 March 2010, the three appellant officers with a police force and a mobile crane came to the plaintiffs' residence and seized a car, following a traffic-fine confrontation and a Section 176 IPC case that the prosecution later withdrew. The court records that when a plaintiff demanded a receipt for the car key, the first defendant assaulted him while the other two held him, and that the elderly mother fainted. A departmental enquiry had found the officers guilty. The High Court dismissed the officers' second appeal, holding the assault was no part of official duty so the Kerala Police Act limitation bar did not apply, the seizure was unjustified, and sustained the Rs.5,00,000 decree with interest against the officers and the State jointly and severally.
