Union of India & Ors. v. ITBP Constable (General Duty)

The judgment of the Supreme Court of India records the following account. ITBP Constable was on sentry duty at the Kote on the night of 4/5 July 2005 when cash boxes meant for disbursement to company personnel were kept there. The Court found he broke open the lock, stole the cash, hid the box about 200 yards away and deserted his post, and was dismissed on 14 November 2005 after a Summary Force Court trial. The Supreme Court held the confession voluntary, the misconduct grave moral turpitude by a sentry in a sensitive border area with eight prior punishments, and dismissal proportionate. It allowed the Union's appeal, set aside the Uttarakhand High Court orders directing reconsideration of punishment, and restored the dismissal.
