Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Karnataka High Court judgment.
The judgment of the Karnataka High Court records the following account. Head Constable of Bagalagunte Police Station demanded Rs.20,000, settled at Rs.10,000, from an accused in Crime No.238/2017 to compromise the matter, receiving Rs.1,000 on 30 June 2017. The complainant recorded the conversation and approached the ACB, which laid a trap on 15 July 2017 in which the accused pocketed marked notes and both hand washes turned pink. The Special Court convicted him in 2021, imposing 3 years RI with Rs.50,000 fine under Section 8 and 4 years RI with Rs.50,000 fine under Section 13(1)(d) read with 13(2) of the PC Act. Justice Sandesh dismissed the appeal, holding demand and acceptance proved through the complainant, panch and trap witnesses, call records and the FSL voice-comparison report, with minor discrepancies not shaking the prosecution case.
