CW-2025-0030Kulgam, Jammu and KashmirJudgment 18 December 2025

UT of J&K & Ors. v. [name withheld]

The judgment of the Jammu and Kashmir and Ladakh High Court records the following account. Constable (J&K Police, appointed 1992), posted with the constabulary guard at the minority picket at Adjin, Kulgam, failed to fire a single round when militants attacked on the night of 7/8 May 2016, surrendering service weapons to them. After inquiry, SP Kulgam dismissed him on 13 October 2016. A Single Judge quashed the dismissal in October 2019 on grounds including inquiry by an allegedly incompetent officer. A Division Bench of Justices Sanjeev Kumar and Sanjay Parihar allowed the UT's appeal, holding the inquiry was by a competent authority with natural justice scrupulously followed, that surrender without firing is cowardice bringing moral disgrace, and that dismissal was not shockingly disproportionate, restoring the dismissal.
