Order issued
ConcludedThe Madhya Pradesh High Court recorded adverse findings against police personnel and ordered Rs 500,000.
In a Datia murder trial (ST 02/2018, Seondha) over the 2017 killing of Kailash, the trial court had directed preservation of call-detail and mobile-location records on 07.09.2018. The Madhya Pradesh High Court (Gwalior Bench) found that then-SP [name withheld] received the records on 17.09.2018 yet deliberately suppressed them, got a false compliance reply filed before the trial court, and acted with mala fide intention to favour one side, violating the fundamental rights of free and fair investigation and trial. The Court directed [name withheld] to personally deposit Rs. 5,00,000 as compensation with the Principal Registrar within one month for disbursal by the trial court to the successful party, ordered the DGP to issue a departmental charge sheet within a month, and directed that the order be kept in his service record. Matters not addressed in the cited judgment text are not recorded here.
