CW-2024-0032Cuddalore, Tamil NaduJudgment 1 March 2024

Neyveli Man & Anr. v. State of Tamil Nadu & Ors.

The judgment of the Madras High Court records the following account. A Neyveli man was arrested on 28 October 2020 by Neyveli police in a chain-snatching case, kept in illegal custody and beaten/tortured until production before the Magistrate on 30 October 2020, remanded, and died in hospital on 4 November 2020 while in judicial custody. The SHRC (10 August 2022) held illegal custody and torture proved and awarded Rs.5 lakh to his wife with recovery from nine police personnel plus disciplinary and prosecution recommendations. The Division Bench confirmed the compensation, the recovery (Rs.3 lakh from the Inspector, Rs.25,000 each from the other eight) and the disciplinary-action direction, holding the arrest-to-production gap a clear case of illegal confinement violating Article 22(2). It set aside only the criminal-prosecution direction, accepting on post-mortem and investigation-wing evidence that the death stemmed from epilepsy and coronary disease and ordered disbursal within three weeks. Matters not addressed in the cited judgment text are not recorded here.
