CW-2023-0054South East Delhi, DelhiJudgment 5 October 2023

South East Delhi Man vs Govt. of NCT of Delhi and Others

The Delhi High Court (Justice Subramonium Prasad) held the 2 September 2022 lock-up detention of a South East Delhi man at Badarpur police station for about 23 minutes without formal arrest, FIR or DD entry high-handed and violative of Article 21 and D.K. Basu. SI picked him up from a stabbing spot and SI placed him in the lock-up for no rhyme or reason. Holding the earlier departmental censure an insufficient deterrent and that police cannot be a law unto themselves, the Court awarded Rs 50,000 compensation recoverable from the two officers' salaries. Matters not addressed in the cited judgment text are not recorded here.
