ConcludedThe Jharkhand High Court recorded adverse findings against police personnel and ordered Rs 800,000.
The Jharkhand High Court found that a Ranchi man, a dhaba waiter arrested at Barachatti (Gaya, [name withheld]) on 6 October 2015, spent about eight years in jail for a crime he did not commit after NCB officials falsely implicated him in an NDPS case. The court noted the NCB itself had twice sought withdrawal of the prosecution under s.321 CrPC, conceding the false implication, and that eight NCB officials had been charge-sheeted under s.58 of the NDPS Act. It quashed the FIR, cognizance order and trial proceedings, ordered the petitioner's forthwith release, and awarded Rs 8 lakh compensation payable through the ADG, NCB Sub Zone Ranchi, recoverable from the erring officials if found guilty. The court held the illegal confinement violated Article 21 and was a proved case of atrocity. Matters not addressed in the cited judgment text are not recorded here.
