Order issued
ConcludedThe Supreme Court of India upheld service punishment imposed on police personnel.
The judgment of the Supreme Court of India records the following account. The petitioner was appointed constable/driver in the CISF on 3 November 2007 but suppressed a pending criminal case (FIR No. 153 of 2003, under Sections 323, 324 and 341 IPC) in his entry-time character-verification certificate. The Commandant initially imposed reduction of pay by one stage; the DIG Headquarters Navi Mumbai suo motu revised the lenient penalty under Rule 54 and ordered a fresh inquiry, which ended in removal from service on 9 March 2010, upheld in departmental appeal and revision. A Single Bench of the Rajasthan High Court twice set aside the removal, but the Division Bench restored it on 16 November 2021. The Supreme Court held suppression of criminal antecedents at entry into a disciplined force is gross misconduct, found the removal followed due process without mala fides, declined to interfere under Article 136 and dismissed the SLP.
