Uttarakhand Police Constable vs State of Uttarakhand

The judgment of the Uttarakhand High Court records the following account. On 25 July 2003 Constable and fellow constables were escorting accused [name withheld] back after production before the Special Judge (Gangster Act) when he escaped from their custody at the railway station. The trial court convicted [name withheld] under Section 223 IPC in August 2018 with a Rs 2,000 fine, acquitting him under Section 224, and the I Additional Sessions Judge, Haridwar dismissed his appeal in December 2022. In criminal revision the Uttarakhand High Court left the findings of the courts below untouched but, noting 20-year pendency, a clean record and probation granted to two co-accused, altered the sentence to release on probation of good conduct for six months on a Rs 30,000 bond. The court directed that Section 12 of the Probation of Offenders Act, 1958 shall apply. Matters not addressed in the cited judgment text are not recorded here.
