ConcludedThe Bombay High Court recorded adverse findings against police personnel and ordered Rs 1,529,600.
The Bombay High Court (Aurangabad Bench) held that the death of 23-year-old Pradip Kute on 04-11-2018 was a homicidal custodial death at the hands of two head constables of the Manegaon outpost, who intercepted his sugarcane tractor over a loudly played tape recorder and beat him with sticks, kicks and fists. Relying on the Section 176(1)(a) CrPC magisterial inquiry report, 43 ante-mortem injuries in the post-mortem, and consistent eyewitnesses, the court rejected the defence of brain disease and post-mortem injuries. It awarded Rs 15,29,600 compensation to the mother (Rs 13,29,600 dependency plus Rs 2,00,000 for police atrocities), payable by the State within two months with 6% default interest and recoverable from the two constables, with Rs 10 lakh to be invested for five years; the criminal trial (Crime No. 218/2018) was noted as pending.
