CW-2022-0034Kolkata, West BengalJudgment 23 November 2022

Union of India & Ors. v. CISF Constable

The judgment of the Supreme Court of India records the following account. Constable of the CISF Unit at Kolkata Port Trust was on armed C-shift guard at the Alif Nagar Scrap Yard, Garden Reach, on the night of 7/8 November 2007, when about 800 kg of copper wire was stolen from the yard and intercepted by local police outside the port. Charged with gross negligence and dereliction of duty plus an incorrigible record of eight punishments in thirteen years, he was dismissed on 27 November 2008 after inquiry, upheld in departmental appeal and revision. A Single Judge of the Calcutta High Court substituted compulsory retirement and the Division Bench ordered reinstatement with back wages. The Supreme Court held the dismissal commensurate with the misconduct and past record, allowed the Union appeals, dismissed the constable appeals and restored the dismissal.
