ConcludedThe Karnataka High Court recorded adverse findings against police personnel and ordered Rs 200,000.
The judgment of the Karnataka High Court records the following account. The petitioner, a 30-year-old law student, was arrested pursuant to a non-bailable warrant in a cheque bounce case, handcuffed without justification, paraded in Ankali market place, and transported in a public KSRTC bus in handcuffs. The Dharwad Bench of the Karnataka High Court held that routine handcuffing without recorded reasons violates Article 21 and Supreme Court precedents in Prem Shankar Shukla and Sunil Batra. The High Court awarded Rs 2,00,000 compensation to the petitioner with liberty to the State to recover it from the delinquent officers, and issued statewide mandatory directions on handcuffing, video conferencing, and body-worn cameras for arresting officers.
