ConcludedThe Kerala High Court recorded adverse findings against police personnel and ordered Rs 150,000.
The Kerala High Court (Devan Ramachandran, J.) held that Pink Police Constable illegal detention and public humiliation of 8-year-old a 8-year-old girl at Attingal on 27 August 2021, on the false allegation that the child possessed the officer own missing phone, violated the child fundamental right to live with dignity under Article 21. The Court rejected the State claim to protection under Section 113 of the Kerala Police Act, 2011, holding the officer acted in her own cause as judge, jury and executioner rather than in discharge of duty. It directed the State to pay Rs.1,50,000 compensation plus Rs.25,000 costs within one month under public-law strict liability, and directed the supervisory authority to consider disciplinary action while keeping the officer off public-facing duties with interpersonal-skills training meanwhile. The officer apology on record was declined by the family; the Court declined to order her removal, noting her financial hardship.
