Delhi Resident v. [name withheld] (DCP) & Ors.

The Delhi High Court held Delhi Police Sub-Inspector of PS Maurya Enclave guilty of criminal contempt for arresting petitioner [name withheld] on 23 August 2020 without serving Section 41A CrPC notice, in breach of the Supreme Court's Arnesh Kumar guidelines. The court found the arrest illegal since only Sections 406/34 IPC (maximum 3 years) were alleged, and the petitioner suffered 11 days incarceration before bail. The court rejected the officer's belated apology as showing no contrition and held his highhandedness violated the petitioner's Article 21 liberty. It sentenced him to one day simple imprisonment with Rs.2,000 fine and Rs.15,000 costs to the petitioner, keeping sentence in abeyance for two months to allow challenge. Matters not addressed in the cited judgment text are not recorded here.
