Halvad Police Unarmed Police Constable vs State of Gujarat

The judgment of the Gujarat High Court records the following account. Unarmed Police Constable B.[name withheld] of Halvad Police Station went on casual leave from 30 June to 2 July 2000 and never reported back on 3 July 2000, remaining absent despite arrest in October 2001 in a case under Section 145(2) of the Bombay (now Gujarat) Police Act. He was charge-sheeted for withdrawing from duty without written permission of the Superintendent of Police and dismissed on 21 October 2003, confirmed by the Range IG and the DGP. He contended sickness certificates explained part of the absence. The Court held the unauthorised absence stood proved and his conscious defiant attitude intolerable in a disciplined force, rejecting the petition. Matters not addressed in the cited judgment text are not recorded here.
