Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Allahabad High Court judgment.
The judgment of the Allahabad High Court records the following account. A Barhapur man, a sewadar at Gurudwara Rakabganj in Delhi, was abducted from outside the gurudwara on 30 October 1992 by a U.P. police party led by SHO Dhirendra Singh Yadav and shot dead the next morning in Kanshiwala jungle, Bijnor, in what police claimed was an encounter with a Sikh militant during combing operations. False cases were registered at PS Barhapur and an AK-56 rifle planted beside the body. On a relative's writ petition the Supreme Court entrusted investigation to the CBI, which charge-sheeted the police party, and the Special CBI Court at Ghaziabad convicted 17 policemen and sentenced them to life imprisonment in March 2012. The High Court dismissed all appeals, holding the extra-judicial killing, abduction and fabrication of records proved beyond reasonable doubt and the self-defence encounter claim palpably false, cancelling Jaipal Singh's bail and taking him into custody.
