ConcludedThe Bombay High Court recorded adverse findings against police personnel and ordered Rs 200,000.
The judgment of the Bombay High Court records the following account. A Deoli man and his son Dr. Indraprasad Futane, parties to a temple-trust dispute in Deoli, were detained at Deoli police station from 5:00 AM to 12:00 PM on 5 February 2014 under Section 151(1) CrPC before being taken to an Executive Magistrate. The Bombay High Court found that the police officer had no knowledge of any design to commit a cognizable offence and that earlier complaints were non-cognizable, holding the Section 151(1) justification misleading and a cover-up for illegal and motivated detention. Drawing an adverse inference for the non-production and loss of official records, the High Court declared the detention illegal, quashed the Chapter VIII CrPC proceedings, ordered Police Inspector Dhananjay Sayare to pay compensation of Rs 1 lakh to each petitioner personally along with Rs 10,000 costs each, and directed that an entry of the judgment be recorded in the officer's service book. Matters not addressed in the cited judgment text are not recorded here.
