ConcludedThe Karnataka High Court upheld service punishment imposed on police personnel.
The judgment of the Karnataka High Court records the following account. Petitioner [name withheld], a constable in the Second Regiment of the Karnataka State Reserve Police (KSRP) at Belagavi, was dismissed from service in November 2003 following a departmental enquiry into gross misconduct arising from his arrest in Crime No. 78/2001 for attempt to murder and Arms Act offences. After being acquitted in the criminal trial (S.C. No. 126/2003) in 2005, he challenged his dismissal before the Karnataka State Administrative Tribunal and subsequently before the High Court. The Dharwad Bench of the Karnataka High Court dismissed his writ petition and upheld the dismissal from service, holding that departmental proceedings operate under different standards of proof from criminal trials and that an acquittal recorded long after conclusion of disciplinary proceedings does not vitiate the penalty. Matters not addressed in the cited judgment text are not recorded here.
