State of Rajasthan and Others vs Jaipur Police Constable

The judgment of the Rajasthan High Court records the following account. Constable, posted as Cycle Sawar, was charge-sheeted for long unauthorised absence while drawing salary, having reported neither at the Police Line nor at the DGP's residence for nearly a year yet managing attendance entries. A disciplinary enquiry found the charges proved and he was dismissed; a Single Judge quashed the dismissal as unproved and the enquiry defective. The Division Bench reversed the Single Judge on proof, holding the department proved the absence with managed attendance, but held dismissal shockingly disproportionate for a first absence-only misconduct and substituted compulsory retirement with retiral benefits. No civilian victim is involved. Matters not addressed in the cited judgment text are not recorded here.
