ConcludedThe Supreme Court of India recorded adverse findings against police personnel and ordered Rs 700,000.
The judgment of the Supreme Court of India records the following account. A Nanded man died an unnatural death in the Vajirabad Police Station lock-up, Nanded, while in custody in Crime No. 104/2013 of Vimantal Police Station; his parents and daughter obtained Rs 7 lakh compensation from the Bombay High Court's Aurangabad Bench (Crl WP 39/2015, 4.7.2016), which also ordered immediate recovery from the Investigating Officer-in-charge, Amol Kadu. The Supreme Court affirmed that monetary compensation is an appropriate remedy for the established infringement of the fundamental right to life and that the State is vicariously liable on strict liability. It modified only the recovery direction, holding the State may recover from the erring officials once liability for the crime is fastened, and disposed of the appeal in those terms.
