Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Kerala High Court judgment.
The judgment of the Kerala High Court records the following account. The 1st accused, a constable of Ernakulam Central Police Station, demanded Rs 25,000 from mobile-recharge trader [name withheld] over telephone from 23 January 2007, threatening to arraign him in the Crime 53/2007 theft case, and was trapped by VACB on 1 February 2007 accepting Rs 15,000 in tainted currency at the complainant's shop; demand was proved through the complainant's advocate-relative and acceptance by trap witnesses with phenolphthalein tests. The Special Court convicted all three accused, but the Kerala High Court held there was no demand or conspiracy proof against the ASI (A3) and the Mulavukadu constable (A2), who had merely counted the notes, and acquitted them. The court confirmed the 1st accused's conviction under Sections 7 and 13(2) read with Section 13(1)(d) of the PC Act, reducing only the Section 13 jail term to six months rigorous imprisonment with fines maintained.
