Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Punjab and Haryana High Court judgment.
On 6 July 2011 custody of undertrial Harnam Singh was handed to three Sangrur Head Constables for production before the Special Court at Hanumangarh, Rajasthan, and he escaped from their custody on 7 July 2011. The Judicial Magistrate First Class, Sangrur convicted all three under Section 223 IPC (one year simple imprisonment plus Rs 1,000 fine), and the Additional Sessions Judge affirmed on 3 June 2016. The High Court found no illegality in the concurrent findings, upheld jurisdiction at Sangrur and held no sanction was needed, noting the circumstances within the accused special knowledge went unexplained. Maintaining the conviction, the court set aside the substantive sentence and released the three on probation for one year on Rs 25,000 bonds, with Section 12 protection so the conviction is no disqualification.
