CW-2016-0025Patna, BiharJudgment 27 April 2016

Union of India vs Patna Police Constable

The Jharkhand High Court Division Bench allowed the Union of India appeal and restored the dismissal of CISF Constable, setting aside the Single Bench order of 8 March 2013. The court held that his admitted abandonment of the Shatabdi Bhawan strong-room post during the 1999 Lok Sabha elections, leaving a 7.62mm rifle and 50 rounds unguarded, amounted to dereliction, negligence, indiscipline and wilful disobedience. It disbelieved the illness defence and held dismissal was not disproportionate for a member of a disciplined force. The dismissal of 25 September 2000, already affirmed in appeal and revision, therefore stands.
