CW-2016-0024Rajnandgaon, ChhattisgarhJudgment 18 April 2016

Rajnandgaon Police Constable v. The State of Chhattisgarh & Ors.

On 18 April 2016 the Chhattisgarh High Court (Prashant Kumar Mishra, J.) dismissed the writ petition of Constable of the District Force, Rajnandgaon, upholding his dismissal from service. The 2003 charge sheet alleged 43 days of unauthorised absence (21 September to 4 November 2002), an indecent act with a woman complainant tarnishing the force's image, and incorrigibility despite 12 prior punishments. The court held the indecent-behaviour charge was proved on the prosecutrix's independent deposition in the departmental enquiry and therefore unaffected by his acquittal under Section 376 IPC in Sessions Trial No. 169/2002, and that prolonged absence after release on bail was serious misconduct for a member of a disciplined force. A Division Bench dismissed his writ appeal in 2019 (WPC No. 2638/2019). No compensation was in issue. Matters not addressed in the cited judgment text are not recorded here.
