CW-2016-0017Palamu, JharkhandJudgment 19 February 2016

Jharkhand Armed Police Constable vs The State of Jharkhand and Others

The Jharkhand High Court disposed of as devoid of merit the writ petition of JAP-3 Constable against his dismissal for ten days of leave without information and failure to rejoin duty despite repeated directions. The court held the enquiry rested on overwhelming material with no procedural infirmity and that judicial review does not permit reappreciation of enquiry evidence. It found no ground to interfere with the dismissal order of 24 January 2014. The dismissal therefore stands. Matters not addressed in the cited judgment text are not recorded here.
