Govindpur Police Constable vs The State of Jharkhand

The Jharkhand High Court Division Bench (Virender Singh CJ, Shree Chandrashekhar J.) on 16 February 2016 dismissed the LPA of Dhanbad Constable and upheld his dismissal from service. The court recorded that on 20-21 August 2010 he impersonated the Superintendent of Police bodyguard, demanded Rs. 12,000 from truck driver [name withheld] for releasing his truck and accepted Rs. 5,000, besides absconding from duty. The court held the jail-recorded enquiry was fair, the compromise-based criminal acquittal did not touch the departmental findings, and the appellate order showed proper application of mind. The dismissal, already affirmed in appeal, memorial and writ, was consequently sustained.
