ConcludedThe Bombay High Court recorded adverse findings against police personnel and ordered Rs 400,000.
The Bombay High Court held that the Daman administration grossly violated journalist Satish Sharma's fundamental rights under Article 21 by illegally handcuffing and parading him, then an undertrial in an extortion case, from Nani Daman bus stand to Daman police station through a crowded market on 2 July 2009. The parading, by three police constables without magisterial permission, was contrary to the Supreme Court's Prem Shankar Shukla and Citizens for Democracy directions, and stood proved by the unchallenged enquiry report of the Principal District Judge, Silvassa. The Court directed the Union Territory to pay Rs 4 lakh compensation plus Rs 25,000 costs within two months (9% interest on default), ordered an enquiry to fix responsibility on the erring officers, and kept the petitioner's civil remedy open.
