CW-2016-0004Uttar Dinajpur, West BengalJudgment 3 August 2016

State of West Bengal & Ors. v. State Armed Police Constable

State Armed Police constable, posted at Raiganj, was accused in Raiganj PS Case 383/2007 (Sections 419/420/120-B IPC) over impersonation to procure constable employment, and was dismissed in January 2012 after a departmental enquiry for tarnishing the police image. Though honourably acquitted in the criminal trial, the Division Bench followed State of WB v. [name withheld] and held there is no provision under the Police Regulations to reinstate an employee acquitted of a criminal charge. The State's petition was allowed and the Tribunal's reinstatement order quashed. Matters not addressed in the cited judgment text are not recorded here.
