CW-2015-0037Dhanbad, JharkhandJudgment 4 December 2015

Jharkhand Police Constable vs The State of Jharkhand and Others

The Jharkhand High Court (Pramath Patnaik J.) dismissed a Dhanbad constable writ against his dismissal dated 6 March 2010. The court found proved gross negligence on prisoner-ward guard duty at PMCH, where an undertrial suffered burn injuries on 22 September 2008 and an inspection later found no uniformed guard at the ward. It held three concurrent evidence-based findings cannot be reappraised under Article 226 given the serious misconduct. The dismissal, affirmed in appeal and revision, therefore stands.
