ConcludedThe Madras High Court recorded adverse findings against police personnel and ordered Rs 1,600,000.
The judgment of the Madras High Court records the following account. Justice S. Nagamuthu found that four men were implicated as accused in the 2002 Murappanadu murder case (Crime No.147 of 2002), arrested, detained in prison for a considerable time and made to undergo the ordeal of trial in S.C.No.259 of 2005, though the supposed victim [name withheld] was alive - a fact the court confirmed by examining her and others as court witnesses (paras 2, 40, 44). The trial court had ACQUITTED all four on 20.02.2007 and that acquittal had become final (para 2). The court held the investigating officers had acted in good faith and by mistake of fact guided by the forensic superimposition report, committed no offence, and made out no prima facie case for registration of any case against them (paras 37-41). It set aside the final report, cognizance, trial and judgment, discharged all four accused and reopened the investigation under DSP, DCB Tuticorin (para 54(i)-(iii)). Holding serious human-rights violations of the accused by State officers established (para 44), it awarded Rs.4,00,000 to each of the four accused (Rs.16,00,000 total) within three months (para 54(v)), and dismissed the plea for an FIR against the officers (para 54(iv)). The respondents contended the officers acted in good faith by mistake of fact and taxpayer money should not be paid (para 43). Matters not addressed in the cited judgment text are not recorded here.
