ConcludedThe Kerala High Court recorded adverse findings against police personnel and ordered Rs 100,000.
The judgment of the Kerala High Court records the following account. A Vellamunda man was taken in a police jeep on 20-05-2014 by the anti-naxal squad on mere suspicion of being a Maoist, interrogated, body-searched and had his house searched and devices seized, then released without any crime registered. The court disbelieved the police rescue-from-mob plea on the General Diary, held mere Maoist ideology is no ground for custody, and found the State bound to compensate. It directed the State to pay Rs. 1 lakh compensation plus Rs. 10,000 costs within two months, declining individual-officer liability and departmental action. The compensation direction survived the State's appeal and its SLP was dismissed by the Supreme Court in 2024.
