Lohar Majra Man v. State of Haryana and Others

A Lohar Majra man's daughter was found raped and murdered on 27-12-1993; after he named three suspects to the SHO, he was himself detained, arrested and prosecuted for her rape and murder. The court found, relying on an earlier PIL finding and a CBI report, that the investigation was inept and motivated: the suspects were never interrogated, fingerprints were never collected, and recovery-memo evidence was manipulated. It held the petitioner had suffered malicious prosecution and unjustified incarceration at the hands of the SHO as Investigating Officer with the Superintendent of Police as mentor. The State was ordered to pay Rs. 5 lakh with 9% interest from the date of petition plus Rs. 10,000 costs, with liberty to recover from the two officers. Matters not addressed in the cited judgment text are not recorded here.
