CW-2014-0040Kolkata, West BengalJudgment 19 December 2014

Kolkata Woman & Ors. v. The State of West Bengal & Ors.

Kolkata Police constable pleaded guilty to unauthorised absence from 15 December 2000, with 16 prior punishments and 164 days of extraordinary leave on record, and was dismissed with effect from 6 April 2001. His legal representatives later sought rescission citing a December 2011 criminal acquittal, but the West Bengal Administrative Tribunal dismissed the 2012 original application. The Calcutta High Court held the Tribunal could not condone the nine-year delay, that Regulation 8 permits dismissal for absence, and that the penalty was not shockingly disproportionate. The WPST was dismissed on 19 December 2014. Matters not addressed in the cited judgment text are not recorded here.
