CW-2014-0029Jalgaon, MaharashtraJudgment 30 July 2014

Bhusawal Man & Anr v. State of Maharashtra & Ors.

The judgment of the Bombay High Court records the following account. Two Bhusawal labourers who went to lodge a complaint were instead detained on 23.08.2005, arrested under s.41(2) CrPC in chapter cases under s.110(e)(g), and kept in custody till 27.08.2005 though relatives were ready with sureties. The court held there is no power to arrest on initiation of chapter proceedings, the s.41(2) arrest was unwarranted, and CrPC, constitutional and D.K. Basu safeguards were ignored. It directed the State to pay Rs.10,000 to each petitioner and to hold a departmental inquiry against the two named officers. Matters not addressed in the cited judgment text are not recorded here.
