CW-2014-0019Rajkot, GujaratJudgment 5 February 2014

Gondal Police Head Constable (Grade-I) and others vs State of Gujarat & Ors.

On 5 February 2014 the Gujarat High Court Division Bench dismissed appeals by two Gondal lady head constables and upheld their dismissal from service. The court found that a woman accused entrusted to their overnight custody on 6-7 October 1993 had escaped through their negligence, for which both stood finally convicted under section 225A(b) IPC (six months simple imprisonment plus fine). The court held the escape reflected gross negligence and consequential misconduct by police custodians, and that dismissal was neither shockingly nor grossly disproportionate. Matters not addressed in the cited judgment text are not recorded here.
