Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Delhi High Court judgment.
The judgment of the Delhi High Court records the following account. Delhi Police Head Constable fired his issued 9mm service revolver at a Shahdara man during a late-night quarrel between two groups near Shahdara on 12 May 1996, inflicting a bullet injury that hospitalised the victim for several days. The Sessions Court convicted him under Section 307/34 IPC and Section 27 of the Arms Act in January 1999 while acquitting his two co-accused. The Delhi High Court held he had misused his official weapon, fired at a vital organ without reasonable apprehension and fled, and that he deserved no leniency given his nexus with criminals. It affirmed the conviction and sentence, dismissed the appeal and directed him to surrender on 6 February 2014 to serve the remaining sentence.
