ConcludedThe Madras High Court recorded adverse findings against police personnel and ordered Rs 500,000.
The Madras High Court awarded Rs 5,00,000 total compensation to the family of 42-year-old tailor a Madurai man, who was beaten in the course of enquiry at Pudur Police Station, Madurai, on 19.9.2000, handed over unconscious to his family, and died in hospital at 11 pm on 20.9.2000 (paras 2, 8). Justice K.B.K. Vasuki recorded that the post-mortem certificate showed 20 antemortem injuries plus chest contusion, temporal contusion and subdural hemorrhage (para 7), and held police personnel 'solely responsible for causing injuries, which are the major cause for the death' (para 10). The respondents contended death was due to ethyl alcohol poisoning and injuries sustained outside the station at Pudur bus stand (para 4). Citing Supreme Court precedents on State liability for Article 21 violations, the Court directed the State to deposit the remaining Rs 4,00,000 (after adjusting Rs 1,00,000 interim relief) for investment in bank deposits for the widow and two children (paras 12-13).
