ConcludedThe Madhya Pradesh High Court upheld service punishment imposed on police personnel.
Head Constable, with 23 years of service in the Madhya Pradesh Police, was charge-sheeted on 8 June 2001 on two charges arising from an incident dated 20 July 2001, and a regular departmental enquiry found both charges established on the evidence of eyewitnesses, leading to dismissal from service affirmed on appeal. He challenged the dismissal on grounds including reliance on a preliminary enquiry, hearsay, the incident occurring off duty hours and outside his posting area, and disproportionality. The Madhya Pradesh High Court held it was not a case of no evidence, that off-duty conduct reflecting on establishment discipline amounts to misconduct, and that the charges were very grave with punishment commensurate to the misconduct. The Court observed his conduct was highly improper and unbecoming of a police constable, and dismissed the petition with no costs.
