ConcludedThe Punjab and Haryana High Court recorded adverse findings against police personnel and ordered Rs 500,000.
The judgment of the Punjab and Haryana High Court records the following account. A Ludhiana man, a B.Sc. student of Punjab Agricultural University, was forcibly picked up from his Ludhiana home on 9 July 1989 by a police party headed by DSP; his father telegraphed the Chief Justice apprehending torture and false implication, which was treated as habeas corpus CrWP 2301 of 1989. The family then learned from a newspaper report that a Ludhiana man had been killed in an encounter on 19 July 1989. The High Court rejected the State's delay and disputed-facts objections, holding the admitted pickup followed by encounter death established the Article 21 infringement. Finding Rs. 5,00,000 reasonable compensation for the aggrieved mother, the Court allowed the writ and directed payment within two months.
