Bihar Military Police Sepoy vs State of Bihar and Others

Sepoy of BMP-II, Jamshedpur, was caught stealing an iron angle from the Lalbabu Tube Company on the night of 4/5 January 1979 (then undivided Bihar) and dismissed after a departmental enquiry, but the Ranchi Bench quashed that dismissal in 1991 for non-supply of documents and ordered a fresh enquiry. A de novo enquiry again proved the charge, leading to dismissal in May 1994 and rejection of his appeal. The Jharkhand High Court found all documents and the enquiry report had been served with the 1994 show-cause and rejected the non-supply plea. The Court held a sepoy caught red-handed stealing amply justified dismissal and dismissed the writ petition. Matters not addressed in the cited judgment text are not recorded here.
