CW-2012-0034West BengalJudgment 11 September 2012

BSF Constable vs The Union of India and Others

The judgment of the Madhya Pradesh High Court records the following account. BSF Constable was charge-sheeted for slapping Assistant Commandant a West Bengal man, his Company Commandant, on the left cheek and threatening to shoot and kill him without provocation on 29 June 1999 at about 19:45 hours. A Summary Security Force Court convened on 5 July 1999 established his guilt and the Commandant dismissed him from service the same day. An earlier dismissal of his writ on jurisdiction grounds was set aside by a Division Bench in 2007 and the matter was heard on merits. The Madhya Pradesh High Court held the assault on a superior officer was proved in a properly conducted departmental inquiry, the cited judgments had no relevance to the peculiar facts, and dismissed the petition, sustaining the dismissal. Matters not addressed in the cited judgment text are not recorded here.
