Uttarakhand Police Head Constable v. State of Uttarakhand

The judgment of the Supreme Court of India records the following account. On the night of 15 November 2004, acting on a liquor-smuggling tip, Head Constable with three constables intercepted a Maruti car near IDPL Gate, Rishikesh, and when it failed to stop, [name withheld] fired a single.38-bore shot that struck front-seat passenger a Rishikesh woman in the temple, killing her. The Sessions Judge, Dehradun convicted [name withheld] under s.302/34 IPC and s.27(1) Arms Act with life imprisonment but acquitted the three constables. The Uttarakhand High Court dismissed [name withheld]'s appeals confirming his life sentence, while additionally convicting the three constables in the State's appeal. The Supreme Court (2025 INSC 114) quashed the three constables' conviction for want of common intention but affirmed the trial judgment, leaving [name withheld]'s life conviction intact. Matters not addressed in the cited judgment text are not recorded here.
