ConcludedThe Madras High Court recorded adverse findings against police personnel and ordered Rs 500,000.
The judgment of the Madras High Court records the following account. Undertrial Ramasamy @ a Udagamandalam man, lodged in Ooty Sub-Jail in Cr.No.204 of 2002, fell sick on the morning of 15.8.2002 and died about 10.45 a.m. after being left without timely medical treatment. The Court relied on the RDO Coonoor enquiry, which found injuries inflicted in the presence of police personnel, falsified jail-admission records, and a two-hour denial of treatment for chest pain. It held the subordinate police and jail officials solely responsible for the loss of life through callous indifference and the State vicariously liable. Enhancing compensation to Rs.5 lakh total, it directed the Rs.4 lakh balance paid within 12 weeks, recoverable from the delinquent policemen and wardens. Matters not addressed in the cited judgment text are not recorded here.
