ConcludedThe Punjab and Haryana High Court recorded adverse findings against police personnel and ordered Rs 600,000.
The judgment of the Punjab and Haryana High Court records the following account. A Kaithal man and a Kaithal woman, both majors, married on 7 April 2007 against a Kaithal woman's family's wishes, and the Sessions Judge Kaithal directed the SP Kaithal to ensure their safety while granting a Kaithal man anticipatory bail on 12 June 2007. After recording Section 164 CrPC statements on 15 June 2007, the couple left Kaithal in a police gypsy, but the escort party took a written no-protection note and left them at Pipli without informing superiors, while HC leaked their whereabouts to the accused; their bodies were recovered from Barwala Link Canal on 23 June 2007. The trial court convicted all the private accused on 25 March 2010 and observed the police had abandoned the couple. Relying on D.K. Basu and [name withheld] v. State of Punjab, the High Court rejected the State's nascent Victim Compensation Scheme defence and directed Rs 3 lakh each for the two deaths (Rs 6 lakh total) to petitioner [name withheld], allowing the petition.
