Bahadurgarh Police Head Constable vs State of Haryana

The Punjab and Haryana High Court affirmed the conviction of Head Constable of Police Post Linepar, Bahadurgarh, for demanding Rs 1,000 from a Bahadurgarh man on 18 July 1994 to hush up a matter against his brother. A trap led by DSP Shri Singh with the SDM Rohtak as shadow witness on 19 July 1994 recovered tainted notes from his shirt pocket, corroborated by hand/pocket wash. The Court held demand and acceptance proved by cogent evidence but, given 17 years' pendency and the appellant's age of 73, reduced the sentence from two years' RI to one year's RI with the Rs 1,000 fine maintained. The appellant was ordered to surrender to serve the remaining sentence.
