Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Gujarat High Court judgment.
The Gujarat High Court dismissed the appeal of RPF man Ajaysing Yadav and confirmed his Section 331 IPC conviction for custodial torture leading to the death of an Ahmedabad man The Court found an Ahmedabad man was picked up from his Girdharnagar house on 4 April 1990 for a cement-theft inquiry and beaten by RPF personnel at the railway line and RPF Post, Ahmedabad, sustaining 20 external and 7 internal injuries, dying on 5 April 1990. It discarded the defence story of a fall while fleeing and relied on the mother eyewitness identification, the station-diary entry in the appellant own hand, and medical evidence ruling out a fall. Treating RPF custody as police custody throughout, the Court confirmed 7 years RI plus Rs 10,000 fine payable in full to the mother, leaving the acquittal of accused 2 to 5 and on Section 302 undisturbed.
