CW-2011-0006Bhagalpur, BiharJudgment 2 May 2011

The Matter Of State (Through SPE/CBI/Patna) vs [name withheld] And Ors

In the infamous Bhagalpur blindings case, the Patna High Court allowed the CBI's appeal against the judgment of acquittal passed by the 14th Additional Sessions Judge, Patna, and restored the conviction and sentence against police Officer-in-[name withheld] and police personnel [name withheld]. The accused policemen had rounded up victims a Sabour man and a Sabour man from villages under Sabour Police Station on July 25, 1980, confined them in a school and the police station, and pierced their eyes with a sharp takua before pouring corrosive acid. Holding the lower appellate court's acquittal perverse and unsupported by evidence, the High Court convicted both policemen under Sections 326, 120B, and 220 IPC and directed them to surrender to serve their sentences of rigorous imprisonment. Matters not addressed in the cited judgment text are not recorded here.
